SERVICE CONDITIONS FOR THE STAFF
(Until the common Service Conditions for the Staff of the merged C-DAC comes into effect, C-DAC Mumbai follows the Service Conditions for the Staff of formerly NCST)
1. Pay Scale & Allowances (including HRA)
As per rules laid down by the Council from time to time; for the present these will be as per Central Government rules except that HRA will be at 30% of basic pay upto a ceiling of Rs.1600/- with or without the production of rent receipt. No HRA will be paid to those who are allotted residential accommodation by C-DAC, Mumbai.

2. C.P.F.
The staff of C-DAC, Mumbai may opt for either C-DAC, Mumbai Contributory Provident Fund Scheme (CPF) or C-DAC, Mumbai General Provident Fund (GPF) and C-DAC, Mumbai Pension Scheme.
In case of Technical Staff of C-DAC, Mumbai even after exercising the said option as above, an Officer will be eligible for revising his option, but only once more during the tenure of his service.
In the CPF scheme, a staff member has to contribute at least 10% of his basic pay. Matching contribution upto a maximum of 10% as above will be made by C-DAC, Mumbai. An additional voluntary contribution by the staff will be allowed. If a member wants to leave C-DAC, Mumbai before completing three years of service, 75% of the C-DAC, Mumbai contribution and interest thereon will be forfeited. If he has put in three years or more but less than five years, 50% of C-DAC, Mumbai's contribution and interest thereon will be forfeited. The qualifying service for payment of contribution of C-DAC, Mumbai with interest in full will be 5 years or more.

3. Private consultancy not permitted
C-DAC, Mumbai staff will not provide private consultancy to anyone. Rare expectations to this may, however, be permitted by the Director, C-DAC, Mumbai. Authorisation of such exceptions, if any, will be in writing.

4. Gratuity
Staff members of C-DAC, Mumbai will be covered by the gratuity scheme as per rules laid down by the Council from time to time. They will become eligible for gratuity after completing 10 years of continuous service. Gratuity will be paid to the members at the rate of 15 days of basic pay plus dearness allowance for each completed year of service rendered, up to a maximum of Rs.3,50,000/- only. Gratuity will be payable to members of staff opting for either the CPF, or the GPF and Pension Scheme. Service Gratuity will be paid to staff members who have rendered less than 10 years of service as per Central Government Rules.
5. Pension
The members of the Staff of C-DAC, Mumbai will be covered under pension scheme as per the C-DAC, Mumbai Pension Rules as amended from time to time.
6. Health Scheme
The members of C-DAC, Mumbai will be covered by a health scheme as per rules laid down by the Council from time to time. For the present the following scheme will be made applicable. The scheme outlined here will be subject to safeguards and procedural restrictions that may be imposed by Standing Orders and Instructions that may be issued from time to time.
6.1 Physician/Specialist fees:
If any member of C-DAC, Mumbai or his family (i.e. wife, husband, parents, children, step children and unmarried or widowed sisters) who are wholly dependent on the member, fall sick C-DAC, Mumbai will reimburse the medical expenses including the visits and consultation fees charged by a specialist if his general practitioner advises such consultation.
6.2 Cost of medicines, etc:
The cost of medicines, injections, tests, X-ray, etc. prescribed by the General Practitioner or specialist to member or any member of his family including hospitalisation and nursing charges will be reimbursed by C-DAC, Mumbai on production of bills.
6.3 Opthalmological care, Dental care, etc:
Testing of vision, treatment of eye diseases and full dental care will be covered by this scheme.
6.4 Systems of medicine and entitlement for reimbursement:
C-DAC, Mumbai will not decide which particular doctor the member should consult. It leaves to him to determine which system of medicine he should follow, allopathy, homeopathy, ayurvedic, unani, subject to the doctor prescribing the treatment being a Registered Medical Practitioner. C-DAC, Mumbai will normally reimburse actual expenses on medical attendance and treatment upto an upper limit of two months of pay (basic pay plus dearness pay) in a financial year (April - March).
In any particular year if a member does not spend the full amount available to him, he can carry forward the balance to the following two years. If he still does not utilise the amount carried forward during the following two years, the amount will lapse.
6.5 Medical expenses in excess of entitlement:
When unavoidable medical or surgical expenses have to be incurred beyond the staff member's entitlement, C-DAC, Mumbai would consider the cases sympathetically. In such cases, as far as possible, prior financial approval is to be obtained by making a request properly supported by statement from the doctor treating the case. C-DAC, Mumbai will have a Standing Committee to go through such claims and the Committee will take into consideration, the nature of illness or emergency for which claim is preferred and recommend the extent of payment to be made in such cases. Director, on receipt of recommendation from the Committee, will sanction the amount within the limit set by the Governing Council for this purpose from time to time at his discretion. For any amount exceeding the set limit, the case may be referred to the Governing Council for decision. Payments in excess of a set limit (initially Rs.200/-) will be normally made directly to the Doctor/Hospital concerned. Only in exceptional cases an advance upto one months' basic salary will be given to the staff member. Such an advance will be adjusted against medical claims of the member within 60 days.
6.6 Medical Benefits after Retirement:

The Health Scheme for C-DAC, Mumbai Staff will also cover members of staff who retire after a minimum of twenty years of service. Medical benefits after retirement will be available only to the staff member and his/her spouse. They will not be available to other dependents. The expenses will be reimbursed to the extent of two months' salary last drawn by the member. This could also be carried forward for two years. The member has to produce the bills for the treatment received by him and his wife for getting reimbursement.
7. TA/DA Rules:

TA/DA will be paid to a member of C-DAC, Mumbai in accordance with the TA/DA rules as laid down by the Council from time to time. For the present the following rules will apply:
7.1 Official travel within India:
As a matter of policy C-DAC, Mumbai expects to meet in full all expenses incurred by its staff members on travel for official business. At the same time, C-DAC, Mumbai expects that such expenses are reasonable and justifiable.
7.1.1 Travel by air:
A staff member with a basic pay of Rs.12,375/- per month or more, can travel by air.

Per diem allowances will be calculated on a midnight-to-midnight basis. For expenses incurred for a, portion of a day, C-DAC, Mumbai will reimburse at the following rates:
Exceeding 3 hours
but
less than 12 hours : Half per diem allowance
12 hours and above : Full per diem allowance
7.1.4.3
The above per diem and lodging allowances do not apply to staff members who are stationed outside their permanent head-quarters for more than 60 days at a time at a particular station.
7.1.4.4
Local travel on official duty while on tour will be reimbursed on the basis of actuals.
7.2
Notwithstanding the provisions in 7.1.1 to 7.1.4.4, C-DAC, Mumbai staff may be reimbursed on the basis of actual expenditure, on a case-by-case basis for official travel, by the Director.
7.3
When C-DAC, Mumbai staff travel abroad on official duty, they will be entitled to TA/DA as per Central Government norms. Actual expenses in excess of the norms may be approved by the Director on a case-by-case basis.
8. Children's educational assistance:
In the matter of education of the children of employees of C-DAC, Mumbai, all C-DAC, Mumbai employees will be given assistance under the following schemes:
- Reimbursement of tuition fee
- Subsidy for the purchase of prescribed textbooks and note books
The assistance will be given for study upto 12th standard in recognised institutions. The maximum amount that can be reimbursed is Rs. 50/- per month per child towards tution fees and Rs. 250/- per annum per child for purchase of text books and note books. It can be claimed by a member for maximum of 3 children only. If both husband and wife are working in government/Semi government organization only one of them will be eligible for assistance.
9. House Building Advance:

Members of staff of C-DAC, Mumbai may be given house building advance within the provision made in the budget each year for housing. A member will be eligible for such a loan on completion of five years of continuous service at C-DAC, Mumbai. A member eligible for grant of such an advance will be governed by Central Government Rules in force for payment and recovery. As per rules in force, a maximum of Rs.2.5 lakhs or fifty times of the basic pay, whichever is less, can be paid as an advance. Actual grant of loan will be decided by the Centre, taking into account the funds position and the number of applications in hand.
10. Other loans:
Other loans will be payable to staff of C-DAC, Mumbai according to rules laid down by the Council from time to time. For the present, following loan schemes will be operated.
10.1
Personal loan in amount equivalent to twelve months salary or Rs.25,000/- whichever is less, will be granted at 6% interest to the members of the staff for the purpose of marriage, education etc. of self, daughters and sons and for family and religious functions such as thread-ceremony, naming ceremony etc. and for the purchase of furniture, durables etc. to be recovered in 36 equal monthly instalments. However, in case of purchase of personal computers, the maximum loan amount available shall be Rs. 40,000/- or 12 months basic salary, whichever is less to be recovered in 36 equal monthly instalments.

10.2
Advance to the extent of six months' basic pay to be recovered in 25 monthly instalments in connection with natural calamity will be granted to the members of the staff free of interest.
10.3
Advance for any other unforseen eventuality at the discretion of the Director equal to 2 months' basic salary subject to a maximum of Rs.3,000/- at 4% interest will be payable to members of C-DAC, Mumbai. The amount will be recovered in six monthly instalments.
10.4
The C-DAC, Mumbai staff may be granted advances for purchase of motorcars, motor cycles, scooter or bicycle, within the framework of Central Government Rules, subject to the budget provision, and specific positive recommendations of the Head of Division, and Director as to the value of the employee's services to C-DAC, Mumbai.

11. Transport
C-DAC, Mumbai will provide transport to its staff members from and to Railway Stations / its official staff quarters according to rules laid down by the Council from time to time. For the present, C-DAC, Mumbai will provide free transport to and from C-DAC, Mumbai office building at JVPD and convenient Railway Stations - one each on Central and Western Railway lines and from and to its official residential quarters.
12. Canteen Facility:
C-DAC, Mumbai will provide canteen facility to its staff at the JVPD Office. Where no subsidised canteen facilities are available at a place of work (for the present specifically, Air India Building) reimbursements upto Rs.8/- per meal will be permitted against cash memo or receipt.
13. L.T.C.
The members of C-DAC, Mumbai will be provided LTC facility as per rules laid down by the Governing Council from time to time. For the present, LTC will be made applicable according to Central Government LTC rules in force.
14. Ad hoc Bonus:
Ad hoc Bonus will be paid as per guidelines laid down by the Governing Council from time to time. For the present, ad hoc bonus is paid as per Central Government orders in force - namely 15 days basic salary in a year for the members of staff drawing basic pay of Rs.750/- or less per month.
15. Holidays:
Governing Council of C-DAC, Mumbai will decide the holidays to be followed by C-DAC, Mumbai in a year.
16. Miscellaneous:
If any question arises which is not covered in the above paragraphs, the decision of the Council shall be final in all cases.
17. Encashment of Earned Leave:
Resolution R9/05/98
Clause 17.
The authority competent to sanction leave should automatically grant lump sum cash equivalent of leave salary admissible for the number of days of earned leave at the credit of the employee on the last day of his service subject to a maximum of 300 days.
On resignation or termination of continuous service, encashment of earned leave will be at the discretion of the Director or an authority so designated by the Director. In the normal course, such encashment will be limited to those who have put in minimum of five years of continuous service.
18. Special Terminal Benefits Scheme
(Added in the 16th Council Meeting held on 9.3.94, R7 Resolution R7/03/94)
- The purpose of this scheme is to encourage those who might contribute better elsewhere, than in C-DAC, Mumbai, to leave their services before the date of normal retirement.
- This scheme will apply to all those who have not been offered a promotion in eight years. This clause disqualifies a person who has received a promotion offer in the preceding eight years, for receiving the special terminal benefits, irrespective of whether the person accepted the promotion or not.
- The total payments under this scheme should not exceed half of (the monthly salary on the last working day + relevant dearness allowance) multiplied by the number of remaining months of service.
- Benefits under this scheme will be over and above other terminal benefits, if any.
19. Institutional Consultancy Scheme
The members of C-DAC, Mumbai will be covered by an Institutional Consultancy Scheme as per the rules for operation of this scheme starting from April 1st 1993. The director of the Centre is authorised to implement the scheme for those years for which 65% of C-DAC, Mumbai's recurring expenditure or more, comes out of C-DAC, Mumbai's non-DoE revenue. If the condition is not met, the director will take up the matter with Council, bringing to its attention any significant reasons for the condition not being met.
